Why should I use myPadilla?
In 2010, the Supreme Court made a landmark decision in the case of Padilla v. Kentucky (559 U.S. 356), which requires criminal defense lawyers to inform their non-US citizen clients about the potential immigration consequences of a criminal offense. In Texas, the Court of Criminal Appeals has taken this further by stating that simply providing blanket advice, such as “you may get deported,” is insufficient under Padilla (Ex parte Torres, 483 S.W.3d 35, 46).
myPadilla supports attorneys in complying with this requirement. We provide individualized opinions explaining the legal consequences of one or several criminal charges.
How much does it cost?
This service is free for public defenders and appointed attorneys throughout Texas. We are a non-profit project funded by the Texas Indigent Defense Commission.
How does it work?
Using myPadilla is easy. First, you need to create an account here. Once you’ve submitted your account details, we will review and approve them. Once approved, you will gain access to your dashboard.
Second, you need to submit your intake. It is divided into three parts: the first part concerns the current charges, the second part concerns the client’s criminal history, and the third part concerns the client’s immigration history.
It is crucial to complete the third part (client’s immigration history) jointly with your client. Avoid answering on their behalf (or based on your perception), as this will affect the accuracy of the advice provided.
Do you provide Trainings/CLE?
